1. Electronic Record

This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of domain name https://dooth.ai ('Website'), including the related mobile site and mobile application (hereinafter referred to as 'Platform').

2. Platform Owner

The Platform is owned and operated by MOHAMED V J as a sole proprietorship under the name "Dooth AI", with its business address at Vathukkaparamabil House, Palaprassery, Chengamanad P O, Aluva, Ernakulam, Kerala, India (hereinafter referred to as 'Platform Owner', 'we', 'us', 'our').

3. Terms of Use

Your use of the Platform and services and tools are governed by the following terms and conditions ("Terms of Use") as applicable to the Platform including the applicable policies which are incorporated herein by way of reference. If You transact on the Platform, You shall be subject to the policies that are applicable to the Platform for such transaction. By mere use of the Platform, You shall be contracting with the Platform Owner and these terms and conditions including the policies constitute Your binding obligations, with Platform Owner. These Terms of Use relate to your use of our website, goods (as applicable) or services (as applicable) (collectively, 'Services'). Any terms and conditions proposed by You which are in addition to or which conflict with these Terms of Use are expressly rejected by the Platform Owner and shall be of no force or effect. These Terms of Use can be modified at any time without assigning any reason. It is your responsibility to periodically review these Terms of Use to stay informed of updates.

For the purpose of these Terms of Use, wherever the context so requires 'you', 'your' or 'user' shall mean any natural or legal person who has agreed to become a user/buyer on the Platform.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

The use of Platform and/or availing of our Services is subject to the following Terms of Use:

1. To access and use the Services, you agree to provide true, accurate and complete information to us during and after registration, and you shall be responsible for all acts done through the use of your registered account on the Platform.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials offered on this website or through the Services, for any specific purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
3. Your use of our Services and the Platform is solely and entirely at your own risk and discretion for which we shall not be liable to you in any manner. You are required to independently assess and ensure that the Services meet your requirements.
4. The contents of the Platform and the Services are proprietary to us and are licensed to us. You will not have any authority to claim any intellectual property rights, title, or interest in its contents. The contents includes and is not limited to the design, layout, look and graphics.
5. You acknowledge that unauthorized use of the Platform and/or the Services may lead to action against you as per these Terms of Use and/or applicable laws.
6. You agree to pay us the charges associated with availing the Services.
7. You agree not to use the Platform and/ or Services for any purpose that is unlawful, illegal or forbidden by these Terms, or Indian or local laws that might apply to you.
8. You agree and acknowledge that website and the Services may contain links to other third party websites. On accessing these links, you will be governed by the terms of use, privacy policy and such other policies of such third party websites. These links are provided for your convenience for provide further information.
9. You understand that upon initiating a transaction for availing the Services you are entering into a legally binding and enforceable contract with the Platform Owner for the Services.

5. Description of Service

Dooth AI provides personalized printed greeting card services. We use AI technology as a tool to help create custom card designs that are then printed on premium paper and delivered as physical greeting cards across India.

Our complete service includes:

• AI-assisted design creation (using AI to generate card front images based on your descriptions and photos)
• Custom message creation (you write it yourself or use AI to help craft your message)
• Premium quality printing of your personalized card design
• Physical delivery of printed greeting cards to addresses across India

Important: Dooth AI provides printed greeting card services. The AI technology is used solely as a design tool to create the card design that gets printed. The final product delivered to customers is a physical printed greeting card, not a digital service.

5.1 Credits System

Credits are used during the card design and creation process. Each credit allows you to generate or update a card design using our AI technology. Credits are part of the card creation process and are used to design the card that will be printed.

• You receive 3 free credits when you sign up
• Each credit allows you to generate or update one card design
• If you need more credits to create additional designs or refine your card, you can purchase additional credits at any time
• When you place an order for a printed card, credits used for that card are refunded up to a maximum of 3 credits per card
• Credits are used solely for the card design process - they are not a separate digital service, but part of creating the design for your printed greeting card

6. User Accounts

To use our service, you must create an account using your phone number. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

7. User Content and Copyright

7.1 Your Content Ownership

You retain all ownership rights to any content, images, text, or materials you upload to our service. Dooth AI does not claim any ownership rights over your content. You are solely responsible for all content you upload.

7.2 Limited License to Dooth AI

By uploading content to our service, you grant Dooth AI a limited, non-exclusive, royalty-free license solely to:

• Process and use your content to create personalized greeting cards
• Print physical copies of cards as ordered by you
• Deliver cards to the addresses you specify
• Store your content temporarily for order fulfillment purposes

This license terminates upon completion of your order and delivery. We do not retain, sell, or use your content for any other purpose beyond fulfilling your specific order.

7.3 Copyright Compliance - YOUR RESPONSIBILITY

CRITICAL: You are solely responsible for ensuring that all content you upload does not infringe upon any third-party copyrights, trademarks, or intellectual property rights.

By using our service, you represent and warrant that:

• You own all rights to the content you upload, OR
• You have obtained all necessary licenses, permissions, and authorizations from the copyright owner to use the content
• The content does not violate any copyright, trademark, or other intellectual property rights
• The content is for personal, non-commercial use only

7.4 Personal Use Only

All cards created through our service are intended for personal, non-commercial use only. You may not use our service to create cards for commercial purposes, resale, or any business activities without explicit written permission from Dooth AI.

7.5 Prohibited Content

You agree NOT to upload content that:

• Infringes upon copyrights, trademarks, patents, trade secrets, or other intellectual property rights of any third party
• Contains copyrighted material (images, logos, characters, artwork) without proper authorization
• Is illegal, harmful, or violates any laws
• Contains offensive, defamatory, or inappropriate material
• Violates privacy rights of others
• Is intended for commercial use or resale

8. Payment and Pricing

All prices are listed in Indian Rupees (₹). Payment must be made at the time of order. We reserve the right to change our pricing at any time, but changes will not affect orders already placed.

9. Orders and Delivery

Orders are processed and printed after payment confirmation. Delivery times vary based on location within India. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

10. AI-Generated Content

10.1 AI Generation Process

Our AI generates card designs based on your inputs (text, images, preferences). The AI-created designs are generated for your personal use only. While we strive for quality, AI-generated content may not always meet your expectations. We are not liable for dissatisfaction with AI-generated designs.

10.2 No Ownership Claims

Dooth AI does not claim ownership of AI-generated card designs. The AI-generated designs are created for your personal use in connection with your order. However, you acknowledge that:

• AI-generated content may incorporate elements from training data
• You are responsible for ensuring AI-generated designs do not infringe third-party rights
• AI-generated designs are for personal use only and may not be used commercially
• Dooth AI is a service provider facilitating card creation, printing, and delivery only

11. Intellectual Property

11.1 Dooth AI Website and Platform

All content on our website and platform, including but not limited to text, graphics, logos, software, and website design, is the property of Dooth AI or its content suppliers and is protected by copyright and other intellectual property laws.

11.2 User Content - No Ownership by Dooth

Dooth AI does not claim ownership of any user-uploaded content, images, or materials. You retain all rights to your content. Dooth AI acts solely as a service provider for printing and delivery services.

11.3 Copyright Infringement Claims

If you believe that content uploaded by a user infringes your copyright, please contact us with:

• Identification of the copyrighted work claimed to be infringed
• Identification of the allegedly infringing content
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act on behalf of the copyright owner

Upon receipt of a valid copyright infringement notice, we will investigate and may remove the infringing content and/or terminate the user's account.

12. Indemnification

You shall indemnify and hold harmless Platform Owner, its affiliates, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorney's fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Dooth AI, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use of our service
• Your violation of these Terms of Service
• Your violation of any third-party rights, including but not limited to copyright, trademark, or privacy rights
• Any content you upload that infringes upon intellectual property rights
• Any claims that content you uploaded violates any law or regulation

This indemnification obligation will survive termination of your account and these Terms of Service.

13. Limitation of Liability

13.1 Service Provider Status

Dooth AI acts as a service provider facilitating the creation, printing, and delivery of personalized greeting cards. We do not create, own, or claim rights to user content. We are not responsible for the content users upload or the designs they create.

13.2 Limitation of Damages

To the maximum extent permitted by law, Dooth AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, including but not limited to:

• Copyright infringement claims arising from user-uploaded content
• Intellectual property disputes
• User content violations
• AI-generated design quality issues
• Printing or delivery delays

13.3 No Warranty on Content

Dooth AI makes no warranties regarding the legality, appropriateness, or non-infringement of user-uploaded content or AI-generated designs. Users are solely responsible for ensuring compliance with all applicable laws and third-party rights.

14. Service Provider Disclaimer

IMPORTANT: Dooth AI is a service provider that facilitates card creation, printing, and delivery. We do not:

• Own or claim ownership of any user-uploaded content
• Own or claim ownership of AI-generated card designs
• Verify the copyright status of user-uploaded content
• Guarantee that user content does not infringe third-party rights
• Assume responsibility for copyright violations by users

Users are solely responsible for ensuring all content complies with copyright and intellectual property laws. Dooth AI's role is limited to providing printing and delivery services based on user-provided content.

15. Termination

We reserve the right to terminate or suspend your account and access to our service immediately, without prior notice, for conduct that we believe violates these Terms of Service, including but not limited to:

• Uploading copyrighted content without authorization
• Violating intellectual property rights
• Using our service for commercial purposes without permission
• Any conduct harmful to other users, us, or third parties

16. Force Majeure

Notwithstanding anything contained in these Terms of Use, the parties shall not be liable for any failure to perform an obligation under these Terms if performance is prevented or delayed by a force majeure event.

17. Governing Law

These Terms and any dispute or claim relating to it, or its enforceability, shall be governed by and construed in accordance with the laws of India.

18. Jurisdiction

All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala.

19. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the new Terms of Service on this page and updating the "Last updated" date. Your continued use of our service after changes constitutes acceptance of the modified terms.

20. Severability
